WHEREAS, the culture and traditions that marriage holds represent how the Philippines value beliefs, customs, and the way of life that has been handed down from generation to generation and gives a certain identity as a nation; (SAPAGKAT, ang kultura at tradisyon na taglay ng pag-aasawa ay kumakatawan sa kung paano pinahahalagahan ng Pilipinas ang mga paniniwala, kaugalian, at paraan ng pamumuhay na ipinasa mula sa unang henerasyon hanggang sa henerasyon ng kasalukuyan at nagbibigay ng tiyak na pagkakakilanlan bilang isang bansa)
WHEREAS, Section 12, Article II of the 1986 Philippine Constitution states, “The State recognizes the sanctity of life and shall protect and strengthen the family as a basic autonomous institution;
WHEREAS, the Philippines is one the last major country that does not allow divorce merely because of the influence of the spiritual beliefs of the people; (SAPAGKAT, ang Pilipinas ay isa sa mga huling pangunahing mga bansa na hindi pinapayagan ang diborsyo dahil lamang sa impluwensya ng espirituwal na paniniwala ng mga tao);
WHEREAS, in order to strengthen and promote family solidarity and our long Filipino tradition, the City Council is enacting this Ordinance. (SAPAGKAT, upang palakasin at itaguyod ang pagkakaisa ng pamilya at ang ating mahabang tradisyong Pilipino, ang Sangguniang Panlungsod ay nagpapatibay ng Ordinansang ito)
NOW THEREFORE BE IT ORDAINED, AS IT IS HEREBY ORDAINED, by the Sangguniang Panlungsod of the City of San Juan, Metro Manila, in a session duly assembled, that:
(SAMAKATUWID, upang bigyan ng kahulugan at halaga ang mga nabanggit na katuwiran sa unahan nito ay NAGPAPASIYA, at bagay na PAGPAPASIYAHAN, ang PAGPAPATIBAY sa panukalang ito sa kapulungan ng Sangguniang Panlungsod ng San Juan):
SECTION 1. TITLE. This Ordinance shall be known as the “Golden Wedding Anniversary Incentive Ordinance of the City of San Juan”
(Seksyon 1. Pamagat. Ang Ordinansang ito ay tatawaging "Golden Wedding Anniversary Incentive Ordinance ng Lungsod ng San Juan")
SECTION 2. SCOPE. This Ordinance shall cover those who are permanent residents of the City of San Juan for not less than 10 years. Permanent resident who temporarily resides outside San Juan City for work, as long as one of the couples resides in the City for not less than 3 years at the time of the celebration of the wedding anniversary.
(Seksyon 2. Saklaw. Sakop ng Ordinansang ito ang mga permanenteng residente ng Lungsod ng San Juan nang hindi bababa sa 10 taon. Permanenteng residente na pansamantalang naninirahan sa labas ng San Juan City para sa trabaho, hangga't ang isa sa mga mag-asawa ay naninirahan sa Lungsod ng hindi bababa sa 3 taon sa oras ng pagdiriwang ng anibersaryo ng kasal.)
SECTION 3. QUALIFICATIONS. The following are the qualifications for entitlement to the incentive provided under this Ordinance:
(Seksyon 3. Kwalipikasyon. Ang mga sumusunod ay ang mga kwalipikasyon para sa karapatan sa insentibo na ibinigay sa ilalim ng Ordinansang ito)
1.The marriage, regardless of celebration, must be considered a valid marriage under Philippine Law or Shari’a Law and registered with the Local Civil Registry of the City of San Juan and Philippine Statistics Authority (PSA) or any other offices or agencies that registers marriage; (Ang kasal, anuman ang pagdiriwang, ay dapat ituring na isang balidong kasal sa ilalim ng Batas ng Pilipinas o Shari'a Law at nakarehistro sa Lokal na Rehistro Sibil ng Lungsod ng San Juan at Philippine Statistics Authority (PSA) o anumang iba pang mga opisina o ahensya na nagrerehistro ng kasal)
2.The valid marriage must have existed for fifty (50) years from the time of registration of the said marriage in the Local Civil Registry of the City of San Juan; (Ang balidong kasal ay dapat na umiral ng limampung (50) taon mula sa panahon ng pagpaparehistro ng nasabing kasal sa Lokal na Rehistro Sibil ng Lungsod ng San Juan)
3.For Muslim and Tribal polygamous marriage, only the marriage registered with the Local Civil Registry or Shari’a Circuit Courtwill be granted the incentive; (Para sa Muslim at Tribal polygamous marriage, tanging ang kasal na nakarehistro sa Lokal na Rehistro Sibil o Shari’a Circuit Court ang bibigyan ng insentibo)
4.Prior to the grant of incentives there must be no finding that the couple is in fact separated de facto. (Bago ang pagkakaloob ng mga insentibo ay hindi dapat makita na sa katunayan ang mag-asawa ay hiwalay na talaga).
SECTION 4. REQUIREMENTS - For the availment of the provisions of this Ordinance, married couples must submit the following requirements to the City Population and Development Office:
(Seksyon4.. Mga Kinakailangan - Para sa pagkamit ng mga probisyon ng Ordinansang ito, ang mga mag-asawa ay kailangang magsumite ng mga sumusunod na kinakailangan sa City Population and Development Office)
A. For Marriages solemnized by Philippine Law:
(Para sa mga Kasal na itinalaga ng Batas ng Pilipinas)
a.1). PSA Copy of Marriage Certificate and Certificate of No Marriage (CENOMAR)
(Sertipiko ng Kasal at Sertipiko ng walang Kasal mula sa Philippine Statistics Office)
a.2). Barangay Certification of Marriage (known to have been married and living
together as husband and wife)
(Sertipiko mula sa Barangay na kayo ay Kasal (kilalang mag asawa at nakatira magkasama bilang
mag-asawa)
a.3).One (1) valid Government issued Identification Card
(Isang (1) balidong Kard ng Pagkakakilanlan na inisyu ng Pamahalaan)
a.4).Notarized Certificate of Undertaking that there are No Pending Cases filed for
Annulment by either of the spouses.
(NotaryadongSertipiko ng Pagsasagawa na walang mga nakabinbing Kaso na isinampa sa
pagpapawalang-bisa ng kasal ng alinman sa mga mag-asawa)
B. For Marriages solemnized under the Shari’a Law or other Tribal polygamous
marriages, aside from compliance to Section 4A. Nos. 2, 3 & 4:
(Para sa mga Kasal na ginawa sa ilalim ng Shari'a Law o ibang Tribal polygamous na kasal, bukod sa
pagsunod sa Seksyon 4A. Blg. 2, 3 at 4)
b.1). Marriage must be solemnized under the Muslim rites;
(Ang kasal ay dapat isagawa sa ilalim ng mga ritwal ng Muslim)
b.2). Registered with the Local Civil Registry of the City;
(Nakarehistro saLokal na Rehistro Sibil ng Lungsod ng San Juan)
b.3). Must be registered with PSA or other agencies that registers marriage.
A certification from the National Commission for Muslim Affairs must be
submitted to this effect.
(Kailangang nakarehistro sa PSA o iba pang ahensyang nagrerehistro ng kasal.Ang isang
sertipikasyon mula sa National Commission for Muslim Affairs ay dapat na isinumite sa
ganitong epekto)
b.4). If Muslim is married to more than one (1) spouse, the reward should be divided
equally among those who are entitled to avail of this Ordinance.
(Kung ang Muslim ay kasal sa higit sa isang (1) asawa, dapat hatiin ang gantimpalapantay-
pantay sa mga may karapatan na mapakinabangan ang Ordinansang ito)
SECTION 5. IMPLEMENTING AGENCY- The City Population and Development Office in coordination with the Local Civil Registry is directed to prepare a set of guidelines to effectively implement this Ordinance with the approval of the City Mayor.
(Seksyon5. Ahensya na Nagpapatupad- Ang City Population and Development Office sa pakikipag-ugnayan sa Lokal na Rehistro Sibil ng Lungsod ng San Juan ay inaatasan na maghanda ng isang set ng mga alituntunin upang mabisang maipatupad ang Ordinansang ito sa pag-apruba ng Punong Lungsod)
SECTION 6. AMOUNT OF INCENTIVE – The incentive reward per couple celebrating their Golden wedding anniversary is Fifty Thousand Pesos (P50,000.00), subject to the availability of funds.
(Seksyon 6. Halaga ng Insentibo – Ang insentibo sa bawat mag-asawa na nagdiriwang ng kanilang Golden Wedding Anniversary ay Limampung Libong Piso (P50,000.00), depende sa pagkakaroon ng pondo.
SECTION 7. SOURCE OF FUNDING – The funds necessary for the program shall be charged against the Gender and Development Fund of the Special Appropriation Fund.
(Seksyon 7. Pinagmumulan ng Pagpondo – Ang mga pondong kailangan para sa programa ay dapat singilin mula sa Gender and Development Fund ng Special Appropriation Fund)
SECTION 8. IMPLEMENTING RULES AND REGULATIONS. The Local Civil Registry and the City Mayor’s Office shall provide the details of the necessary (IRR) of this Ordinance.
(Seksyon8. Pagpapatupad ng mga Tuntunin at Regulasyon. Ang Lokal na Rehistro Sibil at ang Opisina ng Punong Lungsod dapat magbigay ng mga detalye ng kinakailangang tuntunin at regulasyon sa pagpapatupad ng Ordinansang ito)
SECTION 9. The City Budget Officer shall set aside the necessary funds and the City Treasurer to disburse the incentive, subject to the usual accounting and auditing procedures and further, subject to the availability of funds.
(Seksyon9.. Ang Opisyal ng Badyet ng Lungsod ay dapat magtabi ng mga kinakailangang pondo at ang Ingat-yaman ng Lungsod upang ibigay ang insentibo, na napapailalim sa karaniwang mga pamamaraan ng accounting at pag-audit at higit pa, napapailalim sa pagkakaroon ng mga pondo)
SECTION 10. SEPARABILITY CLAUSE – If for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid by a competent court, the remaining sections or provisions not affected thereby shall continue to be in full force and effect.
(Seksyon 10. Sugnay ng Paghihiwalay – Kung sa anumang kadahilanan, ang anumang seksyon o probisyon ng Ordinansang ito ay idineklara na labag sa konstitusyon o hindi wasto ng isang karampatang hukuman, ang natitirang mga seksyon o mga probisyon na hindi apektado nito ay patuloyna may bisa at bias).
SECTION 11. REPEALING CLAUSE – All Ordinances contrary to or inconsistent with any of the provisions of this Ordinance are hereby repealed and/or modified accordingly.
(Seksyon 11. Sugnay ng Pagbabawi– Lahat ng mga Ordenansa na salungat sa o hindi naaayon sa alinman sa mga probisyon ng Ordinansang ito ay pinawawalang-bisa at/o binago nang naaayon.)
SECTION 12. The authority, issuance, and approval hereof are subject to and conditioned upon compliance with certain restrictions and to all existing laws, circulars, rules, and regulations.
(Seksyon 12. Ang awtoridad, pagpapalabas, at pag-apruba dito ay napapailalim at nakakondisyon sa pagsunod sa ilang mga paghihigpit at sa lahat ng umiiral na batas, sirkular, tuntunin, at regulasyon.)
SECTION 13. EFFECTIVITY – This Ordinance shall take effect upon approval.
