WHEREAS, Ms. Mary Wong and Ms. Cristina Wong, owners, has requested the Sangguniang Panlungsod to grant a special locational clearance for the construction of a two (2) storey warehouse with a lot area of One Hundred Eighty (180) square meters and Two Hundred Thirty One point Seventy Nine (231.79) square meters total gross floor area at No. 155 V. Cruz Street, Barangay Maytunas, City of San Juan, Metro Manila;
WHEREAS, the building is subject to the provisions of Zoning Ordinance No. 54-2002 and the Land Use Plan of the City of San Juan;
WHEREAS, a special locational clearance is hereby granted in accordance with Art. 3, No. 42 of Zoning Ordinance No. 54-2002;
WHEREAS, the proposed construction will not alter the physical character of the district or area, and it will not permanently injure the use of the other properties considering that there are numerous similar buildings in the same neighboring location.
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of San Juan, Metro Manila in a session duly assembled that:
Section 1. A special locational clearance is hereby issued to Ms. Mary Wong andMs. Cristina Wong, owners, for the construction of a two (2) storey warehouse at No. 155V. Cruz Street, Barangay Maytunas, City of San Juan, Metro Manila.
Section 2.The following requirements must be complied with for the aforementioned construction:
a.)Four point forty (4.40) meters setback from property line along V. Cruz St. at the ground floor up to 2nd floor;
b.)A firewall along Grid 1 from ground floor up to 2nd floor; and
c.)One (1) parking slot
Section 3.The building shall comply with the City Ordinances relative to the issuance of building permits, business licenses and permit to operate/occupy in San Juan City, Metro Manila and compliance to the National Building Code of the Philippines (PD1096): Fire Code of the Philippines (R.A.95140) and other Referral Codes and its Implementing Rules and Regulations.
Section 4. The Building Official/Local Zoning Administration Office shall release all pertinent clearances and authority to the applicant after payment of the necessary fees and charges and compliance with the sections provided in this Ordinance.
Section 5.Any Ordinance or parts or provisions thereof which are inconsistent with any of the provisions of this Ordinance are hereby repealed or modified accordingly.
Section 6.The approval hereof is subject to and conditioned upon full compliance to all existing laws, circulars, and rules and regulations.
