WHEREAS, on March 8, 2020, President Rodrigo R. Duterte, placed the country under State of Public Health Emergency through Proclamation No. 929 in the light of the outbreak and consequent local transmission of COVID-19;
WHEREAS, in January 2021, the World Health Organization issued a call to all countries to work together in solidarity and in each of their best interest to ensure the vaccination of the people. This call of action is aimed to overcome the pandemic and the inequalities that lie at the root of so many global challenges, as well as drive for global recovery;
WHEREAS, the City Government of San Juan in its mandate to protect the lives of its constituents and its neighboring communities implemented measures to curb the spread of COVID-19 including the allocation of funds for the procurement of ready available vaccines in the national and international market;
WHEREAS, the City Government of San Juan is the owner of sixty nine thousand (69,000) doses of AstraZeneca COVID-19 vaccines through the multiparty/tripartite supply agreement entered by the City Government;
WHEREAS, based on the 2022 latest census of the Philippines Statistics Authority, the City of San Juan has a total population of one hundred thirty-three thousand nine hundred fifty-nine (133,959) and the target eighty percent (80%) population to be vaccinated is one hundred seven thousand one hundred sixty seven (107,167);
WHEREAS, according to the Regional Vaccination Operation Center (Data Management Team) as of 06 March 2022, the City has vaccinated two hundred twenty-one point sixty-two percent (221.62%) for at least one dose, two hundred eleven point thirty-nine percent (211.39%) for second dose and sixty-seven point seventeen percent (67.17%) for booster dose;
WHEREAS, the City of San Juan is ranked among the top performing cities in National Capital Region for surpassing the eighty percent (80%) target population and had administered at least primary doses, one hundred percent (100%) of its total population;
WHEREAS, due to its efficient vaccination program and through the leadership of its City Mayor, Honorable Francisco Javier M. Zamora, and its good relationship with Inter-Agency task Force for the Management of Emerging Infectious Diseases, the City of San Juan is the first city to have achieved herd immunity from COVID-19 and it was recognized by no less that the President of the Philippines in his July 2021 State of the Nation Address;
WHEREAS, the City of San Juan also opened its door for the vaccination of non-residents of City of San Juan in order to encourage the public to get vaccinated and be protected from COVID-19;
WHEREAS, the City of San Juan intends to donate and reallocate its procured AstraZeneca COVID-19 vaccines to some local governments in order to make these vaccines available to more people and to fully utilize and prevent any wastage;
WHEREAS, the Provincial Government of La Union, Isabela and Camarines Sur have signified their intentions to accept AstraZeneca vaccine donations from the City Government of San Juan.
NOW THEREFORE, BE IT ORDAINED AS IT HEREBY ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF THE CITY OF SAN JUAN, METRO MANILA, IN SESSION DULY ASSEMBLED THAT:
SECTION 1. AUTHORITY TO MAKE DONATION AND REALLOCATE. The City Government of San Juan hereby authorizes its City Mayor, Francisco Javier M. Zamora, to donate and reallocate AstraZeneca COVID-19 vaccines to the Provincial Government of La Union, Isabela and Camarines Sur provided that the target population in the City of San Juan has received the primary and booster doses of COVID-19 vaccines and provided further that there are remaining available COVID-19 vaccines for the constituents of San Juan who desire to be vaccinated.
The Provincial Government of La Union, Isabela and Camarines Sur shall receive the total number of doses of AstraZeneca COVID-19 vaccines as follows:

All donations made pursuant to this Ordinance shall be subject to the mandate of the Joint Memorandum Circular with subject “Operational Guidelines for the Donation and Subsequent Reallocation of the Local Government Unit procured COVID-19 Vaccine Doses” to be issued by the Department of Health and National Task Force against the COVID-19.
The receiving Local Government Units shall provide for the collection and delivery of vaccines from the City of San Juan to their respective provinces.
SECTION 2.BEST INTEREST OF THE CITY GOVERNMENT AND THE PUBLIC. The donation and reallocation of COVID-19 vaccines of the City Government of San Juan and Provincial Government of La Union, Isabela and Camarines Sur ensure that any arrangement to be entered into shall be to the best interests of the government and the public.
SECTION 3. IMPLEMENTING AUTHORITY – The Office of the City Mayor through the City Health Department, and other Officers as may be authorized are hereby tasked to assist in the implementation of this Ordinance.
SECTION 4. SEPARABILITY CLAUSE. If, for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid by a competent court, the remaining sections or provisions shall not be affected thereby and shall continue to be in full force and effect.
SECTION 5. EFFECTIVITY. This Ordinance shall take effect upon passage of the Sangguniang Panlungsod and approval of the City Mayor in accordance with the law.
