WHEREAS, on February 17, 2020, the City Council approved City Resolution No. 26, Series of 2020 approving the development permit of Mr. Michael Yo Young Neria, owner, for the construction of a ten (10) units, five (5) storey townhouses located at No. 167 Wilson Street, Barangay Sta. Lucia, City of San Juan,. Metro Manila;
WHEREAS, the owner, sent a letter to the City Council requesting for amendment of City Resolution No. 26, Series of 2020 and to grant a special locational clearance for the subdivision and construction of a ten (10) units, five (5) storey townhouses with a lot area of One Thousand Two Hundred Forty One (1,241) square meters and Three Thousand Nine Hundred Nine point Fifty Two (3,909.52) square meters total gross floor area at No. 167 Wilson Street, Barangay Sta. Lucia, City of San Juan, Metro Manila;
WHEREAS, the building is subject to the provisions of Zoning Ordinance No. 54-2002 and the Land Use Plan of the City of San Juan;
WHEREAS, a special locational clearance is hereby granted in accordance with Art. 3, No. 42 of Zoning Ordinance No. 54-2002;
WHEREAS, the proposed construction will not alter the physical character of the district or area, and it will not permanently injure the use of the other properties considering that there are numerous similar buildings in the same neighboring location.
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of San Juan, Metro Manila in a session duly assembled that:
Section 1. A special locational clearance is hereby issued to Mr. Michael Yo Young Neria, owner, for the subdivision and construction of a ten (10) units, five (5) storey townhouses at No. 167 Wilson Street, Barangay Sta. Lucia, City of San Juan, Metro Manila;
Section 2.A One (1) meter setback from the property line at the ground floor up to 5th floor must be complied with.
Section 3.The building shall comply with the City Ordinances relative to the issuance of building permits, business licenses and permit to operate/occupy in San Juan City, Metro Manila and compliance to the National Building Code of the Philippines (PD1096); Fire Code of the Philippines (R.A. 9514) and other Referral Codes and its Implementing Rules and Regulations.
Section 4. The Building Official/Local Zoning Administration Office shall release all pertinent clearances and authority to the applicant after payment of the necessary fees and charges and compliance of Zoning Ordinance No. 54, Series of 2002.
Section 5.Any Ordinance or parts or provisions thereof which are inconsistent with any of the provisions of this Ordinance are hereby repealed or modified accordingly.
Section 6.The approval hereof is subject to and conditioned upon full compliance to all existing laws, circulars, and rules and regulations.
Section 7.Copies of this Ordinance be furnished to all agencies concerned.
