WHEREAS, the 1987 Philippine Constitution provides that the State shall protect and promote the right of all citizens to quality education at all levels;
WHEREAS, the 1987 Philippine Constitution and Presidential Decree 1083, or the Code of Muslim Personal Laws of the Philippines, provides that “the State shall consider the customs, traditions, beliefs and interests of national cultural communities in the formulation and implementation of state policies;
WHEREAS, the Department of Education (“DepEd”), pursuant to 1987 Philippine Constitution and Republic Act No. 10533 otherwise known as the Enhanced Basic Education Act of 2013, issued DepEd Order No. 41, Series of 2017, which enclosed the Policy Guidelines on Madrasah Education in the K to 12 Basic Education Program; which also provides qualification of Teachers and qualification for allowances;
WHEREAS, the program aims to provide Muslim learners with appropriate and relevant educational opportunities while recognizing their cultural context and unique purposes for participating in the program offerings and integrate content and competencies which are relevant and of interest to Muslim learners under Arabic Language and Islamic Values Education (“ALIVE”) in schools.
WHEREAS, the City Government of San Juan recognized that part of its constituents belongs to Islam faith and there is a need to institutionalize the said program in the City of San Juan to harmonize existing DepEd issuances on Muslim education, with new provisions for more effective and efficient program development, implementation and evaluation; It will also serve as the basis for the development of the Manual of Operations for the Governance and Administration of the Madrasah Educational Program (“MEP”);
WHEREAS, Section 16 of Republic Act No. 7160 otherwise known as Local Government Code of 1991 states that, “Every local government unit shall exercise the power expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for efficient and effective governance, and those which are essential to the promotion of the general welfare”;
WHEREAS, Paragraph (1) (xi), Section 458 of Republic Act No. 7160 empowered the Sangguniang Panlungsod, when the finances of the City Government allow, to provide additional allowances and other benefits to public elementary and high school teachers and other national government officials stationed in or assigned to the City; and,
WHEREAS, considering the significance of MEP in the promotion of the rights of cultural communities to develop themselves and achieving the national and local unity, the City Government finds it appropriate to provide allowance to DepEd, San Juan City, in the implementation of the MEP.
NOW THEREFORE, BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF SAN JUAN CITY, METRO MANILA, IN A SESSION DULY ASSEMBLED, that:
SECTION 1. TITLE. This Ordinance shall be known and cited as “ALLOWANCE TO PROGRAM MANAGERS OF THE MADRASAH EDUCATIONAL PROGRAM”.
SECTION 2. COVERAGE. The DepEd, San Juan City together with its Program Managers who are implementing MEP in all public schools within the territorial jurisdiction of the City of San Juan in accordance with DepEd Order No. 41, Series of 2017, which enclosed the Policy Guidelines on Madrasah Education in the K to 12 Basic Education Program, shall receive an allowance from the City Government of San Juan City.
SECTION 3. ALLOWANCE. The allowance shall be implemented in the next following year upon the effectivity of this Ordinance and to be distributed in the following manners. The rate may be adjusted by the City Government through the Office of the City Mayor upon the availability of funds.

SECTION 4. APPROPRIATION. To carry out effectively the intent of this Ordinance, the allowance shall be appropriated and charged against the General Funds of the City of San Juan which shall form part of the yearly budget of the City, subject to the availability of funds and usual accounting and auditing procedures.
SECTION 5. MANAGEMENT COMMITTEE. The City Mayor is hereby authorized to create a Management Committee which include the School Division Superintendent of the City of San Juan or his/her representative that will formulate the framework and guidelines necessary for the implementation of this Ordinance.
SECTION 6. SEPARABILITY CLAUSE. If, for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid by a competent court, the remaining sections or provisions shall not be affected thereby and shall continue to be in full force and effect.
SECTION 7. REPEALING CLAUSE. All ordinances contrary to or inconsistent with any of the provision of this Ordinance are hereby repealed and/or modified accordingly.
SECTION 8. The authority, issuance and approval hereof are subject to compliance to all existing laws, COA rules and regulations on appropriations and expenditures.
SECTION 9. EFFECTIVITY. This Ordinance shall take effect on January 2023 subject to availability of funds.
