WHEREAS, Section 18 of Republic Act No. 7160 provides that: “Local government units shall have the power and authority to create their own sources of revenue and to levy taxes, fees, charges which shall accrue exclusively for their use and disposition and which shall be retained by them”;
WHEREAS, the City Government of San Juan has available spaces for food providers at the food court to service the employees and visitors of the city;
WHEREAS, the City Government intends to lease the said spaces for food providers for the purpose of providing services for the needs of the employees;
NOW THEREFORE, BE IT ORDAINED as it is hereby ordained by the Sangguniang Panlungsod of San Juan, Metro Manila in a session duly assembled that:
SECTION 1. AMENDMENT. Section 56.06 “Business Kiosks at the City of San Juan Government Center” is hereby amended as follows:
“Section 5G.06. “Business Kiosks at the City of San Juan Government Center
1. Rental Rate for the Food Court – The food court consisting of six (6) stalls/spaces with an appropriate area of six (6) square meters each will be available for rent/lease at the minimum rate of Seven Thousand Pesos (P7,000.00) per month subject to public bidding and to the processes prescribed under Government Procurement Reform Act (R.A. No. 9184) and its Implementing Rules and Regulations.”

SECTION 2. AUTHORITY TO ENTER INTO CONTRACTS. The City Mayor is hereby authorized to sign all documents in relation to the lease/rental of the stalls.
SECTION 3. The City Mayor shall issue regulations as to the time of operations and type of business allowable in the area.
SECTION 4. The City Administrator is authorized to directly supervise the implementation of the operation of the said stalls in accordance with this Ordinance and its Implementing Rules and Regulations.
SECTION 5. The City Legal Officer shall certify that all Contracts of Lease are in order and not contrary to existing laws, rules and regulations.
SECTION 6. The authority, issuance, and approval hereof is subject to compliance with existing laws and COA rules and regulations on appropriations, expenditures, and procurement.
SECTION 7.REPEALING CLAUSE- The provisions of existing ordinances, executive orders, and other issuances or portions thereof which are inconsistent herewith are hereby repealed, modified, and amended.
SECTION 8. SEPARABILITY CLAUSE- If any part or provisions of this Ordinance be held unconstitutional or invalid, other parts of provisions hereof, which are not affected thereby shall continue in full force and effect.
SECTION 9. EFFECTIVITY. This Ordinance shall take effect upon approval.
