WHEREAS, Section 76 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991 provides that every local government unit shall design and implement its own organizational structure and staffing pattern taking into consideration its service requirements and financial capability, subject to the minimum standards and guidelines prescribed by the Civil Service Commission;
WHEREAS, Section 9 (B4) of Republic Act No. 9388 otherwise known as the Charter of the City of San Juan provides for the City Mayor to exercise powers to perform the duties and functions to ensure the delivery of basic services and the provision of adequate facilities;
WHEREAS, the City Government conforms with Section 325 of RA 7160 which provided that total appropriations for personal services of local government units for one (1) fiscal year shall not exceed 45% of the total income from regular sources realized in the next preceding fiscal year;
WHEREAS, the City Council has approved City Ordinance No. 44, Series of 2022 creating the Supervising Labor and Employment Officer to further enhance the provision of assistance to San Juaňenos for employment referrals to employers/establishment in the city and facilitate information dissemination of employment requirements/needs of employers/establishment in the city;
WHEREAS, in a letter dated November 7, 2022, Atty. Dennis Ernesto G. Ruiz, City Human Resource Development Officer has requested for the amendment for the qualification standards of the created position;
WHEREAS, this is to further ensure the provision of competent resources enabling the City Government workforce to intensify it performance through responsive, transparent, effective and efficient delivery of public services, and provide San Juaneños an excellent economic and social services.
NOW THEREFORE BE IT ORDAINED AS IT IS HEREBY ORDAINED, by the Sangguniang Panlungsod of the City of San Juan, Metro Manila, in a session duly assembled, that:
Section 1. Creating the City Government Assistant Department Head II under the Public Employment Service Office (PESO) with the following qualifications, duties and compensation:

The Office shall perform the functions as stated under Section 5 (Functions of the PESO) and Section 6 (Other Services of the PESO) of RA 8759 (Public Employment Service Act of 1999.
Section 2. Funding- The newly-created position will make part and integral elements of the Plantilla of the City Government of San Juan, Metro Manila and shall be automatically funded from the personal services component of the Annual Budget of the City Government particularly in the budget of the Public Employment Service Office.
Section 3. The authority, issuance and approval hereof is subject to compliance with all existing law and COA rules and regulations on appropriations and expenditures.
Section 4. Repealing Clause. All Ordinances, resolutions and other issuances or parts thereof, inconsistent or in conflict with the provisions of this Ordinance are hereby repealed or modified accordingly.
Section 5. Separability Clause. If for any reason or reasons, any part of provision of this Ordinance is declared unconstitutional or invalid, other parts, thereof which are not affected thereby shall continue to be in full force and effect.
Section 6. Effectivity Clause- This Ordinance shall take effect upon its approval.
