WHEREAS, Section 16 of the Local Government Code of 1991 or Republic Act No. 7160, also known as the General Welfare Clause, provides in pan that every local government unit shall exercise powers necessary for its efficient and effective governance and those which are essential to the promotion of general welfare;
WHEREAS, Article II, Section 15 of the 1987 Constitution provides that the State shall protect and promote the right to health of the people and instill health consciousness among them;
WHEREAS, R.A. No. 10121, otherwise known as the Philippine Disaster Risk Reduction and Management Act of 2010, states that it is the policy of the State to mainstream disaster risk reduction and climate change in development processes such as policy formulation, socio-economic development planning, budgeting and governance;
WHEREAS, Administrative Order No. 2020-0036 issued by the Departmentof Health (DOH) provides the guidelines on the institutionalization of Disaster Risk Reduction and Management in Health (“DRRM-H”) Plan in City-Wide Health Systems to develop an effective and efficient preparedness and response to public health emergencies and disasters, thus ensuring delivery of essential population-based health services.
NOW THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED by the Sangguniang Panlungsod of the City of San Juan, Metro Manila in a session duly assembled that:
SECTION 1. TITLE OF THE ORDINANCE – This Ordinance shall be known as: AN ORDINANCE INSTITUTIONALIZING THE SAN JUAN CITY DISASTER RISK REDUCTION AND MANAGEMENT IN HEALTH (DRRM-H) AND PROVIDING FOR GUIDELINES AND APPROPRIATING FUNDS THEREOF.
SECTION 2. SCOPE AND APPLICATION – This Ordinance shall apply to all public and private healthcare facilities within the territorial jurisdiction of the City of San Juan.
SECTION 3.DISASTER RISK REDUCTION AND MANAGEMENT IN HEALTH PLANNING COMMITTEE – A Disaster Risk Reduction and Management in Health Planning Committee (“Planning Committee”) is hereby created which shall be composed of:

SECTION 4. OBJECTIVE – The Planning Committee shall guarantee the uninterrupted delivery of essential health services during emergencies and disasters.
SECTION 5.CORE PROCESS – The Planning Committee shall be responsible for governance, service delivery, resource management and mobilization, and information and knowledge management.
SECTION 6.DUTIES AND OBLIGATIONS – The Disaster Risk Reduction and Management in Health Planning Committee shall have the following duties:
a. Ensure managerial, technical, and financial integration through the City Health Officers to enforce the implementation of City-Wide Health Systems (“CWHS”) and functional DRRM-H System and provide the needed resources and support mechanisms to make the integration possible and sustainable;
b. Ensure compliance with the latest standards on DRRM-H;
c. Together with the City Disaster Risk Reduction and Management Office (“CDRRMO”) and Public Health Units, Epidemiological Surveillance Units and Health Promotion Units, deliver the expected DRRM-H function, essential health service and products in all phases of emergency/disaster;
d. Participate in the capacity and capability building activities;
e. Promote and advocate DRRM-H through various platforms applicable and accessible;
f. Implement mechanisms to monitor and evaluate initiatives on the program and report progress;
g. Collaborate and build DRRM-H capacities of CWHS through viable partnership;
h. Ensure the use and management of the Special Health Fund for DRRM-H activities; and
i. Invest and upgrade systems on DRRM-H supported by the Local Investment Planning for Health, Special Health Fund and the City Health Department fund of the local government.
SECTION 7.FUNCTIONS – The Disaster Risk Reduction and Management in Health Planning Committee shall have the following functions:
a. Develop, review and update the DRRM-H Plan;
b. Gather required information and gain commitment of stakeholders;
c. Initiate testing of plans for its functionality and adaptability to current situations;
d. Develop an Annual Operational Plan and other plans relevant to health emergencies and disasters;
e. Review Health Emergency Management Staff annual work and financial plan; and
f. Monitor and evaluate the implementation of the DRRM-H Plan.
SECTION 8.DISASTER RISK REDUCTION AND MANAGEMENT IN HEALTH PLAN – The DRRM-H Plan, a copy of which is hereto attached and made and integral part as Annex “A” is hereby approved subject to existing laws, rules and regulations.
SECTION 9.IMPLEMENTING OFFICES – The City Health Department in coordination with the City Disaster Risk Reduction and Management Office (“CDRRMO”), shall implement the provisions of this Ordinance.
SECTION 10.SEPARABILITY CLAUSE – If for any reason, any section of this Ordinance shall be held unconstitutional or invalid, other sections which are not affected thereby shall continue to be in full force and effect.
SECTION 11. REPEALING CLAUSE - All Ordinances, rules and regulations or parts thereof in conflict with this Ordinance are hereby repealed, provided that the rights that are vested upon the effectivity of this Ordinance shall not impaired.
SECTION 12.The authority, issuance and approval hereof is subject to compliance to all existing laws, circulars, memoranda, rules and regulations.
SECTION 13.EFFECTIVITY – This Ordinance shall take effect upon approval.
