WHEREAS, Ms. Joy Ann So, et.al., has requested the Sangguniang Panlungsod to approve the development permit for the proposed construction of thirty two (32) units, four (4) storey residences under Transfer Certificate of Title (TCT) Nos. 012-2022000067, 012-2022000073, 012-2022000074, 012-2022000075, 012-2022000076, 012-2022000077 with a total lot area of four thousand five hundred sixty five (4,565) square meters and ten thousand four hundred fifty eight point sixty nine (10,458.69) square meters total gross floor area located at 178 Corazon De Jesus cor. P. Narciso Streets, Barangay Corazon De Jesus, City of San Juan, Metro Manila;
WHEREAS, the building is subject to the provisions of Zoning Ordinance No. 54-2002 and the Land Use Plan of the City of San Juan;
WHEREAS, the proposed construction shall comply with the City Ordinances relative to the issuance of building permits, business licenses and permit to operate/occupy in San Juan City, Metro Manila and compliance to the National Building Code of the Philippines (PD 1096), Fire Code of the Philippines (R.A.95140) and other Referral Codes and its Implementing Rules and Regulations.
NOW THEREFORE, BE IT ORDAINEDAS IT IS HEREBY ORDAINED, by the Sangguniang Panlungsod of San Juan, Metro Manila in a session duly assembled that:
Section 1. Development Permit is hereby issued to Ms. Joy Ann So, et.al. for the proposed construction of thirty two (32) units, four (4) storey residences located at 178 Corazon De Jesus cor. P. Narciso Streets., Barangay Corazon De Jesus, City of San Juan, Metro Manila.
Section 2. The following requirements must be complied with for the aforementioned construction:
a) Road setback at the ground floor of three (3.00) meters from property line along P. Narciso St. and two (2.00) meters along Corazon de Jesus;
b) Easement at 2nd floor up to 4th floor of two (2.00) meters from property line along P. Narciso and Corazon De Jesus Streets;
c) Minimum of Thirty Two (32) parking slots;
d) Firewall on three (3) sides of each unit shall be eighty five percent (85%) of the total length of each side of the property line of thirty two (32) units, four (4) storey residence;
e) A seven (7.00) meters road right of way for main driveway and six (6.00) meters road right of way for auxiliary driveway.
Section 3. The building shall comply with the City Ordinance relative to the issuance of building permits, licenses and permits to operate/occupy in San Juan City, Metro Manila and compliance to the National Building Code of the Philippines (PD 1096), Fire Code of the Philippines (R.A. 9514) and other referral Codes and its Implementing Rules and Regulations.
Section 4. The Building Official/Local Zoning Administration Office shall release all pertinent clearances and authority to the applicant after payment of the necessary fees and charges and compliance of Zoning Ordinance No. 54, Series of 2002.
Section 5.Any Ordinance or parts or provisions thereof which are inconsistent with any of the provisions of this Ordinance are hereby repealed or modified accordingly.
Section 6. The approval hereof is subject to and conditioned upon full compliance to all existing laws, circulars, and rules and regulations.
Section 7.Copies of this Ordinance be furnished to all agencies concerned.
